DECLARATION OF CONFORMITY to what?

We have already presented in general the’declaration of conformity “and there we return to clarify certain points.

The declaration of conformity is the step immediately before the application of theEC mark in the procedure of the marking.

It is written after the risk analysis and in order to be truthful, that is consistent with the reality, it is necessary that: 1 they know the regulations related to the product that they are treating, 2 the product complies in the project and in the execution, with all the requirements contained in standards.

The customers perhaps are convinced that those who for example, build a chandelier, are perfectly aware of the regulations related to this product. Unfortunately, this is a rational and ideal condition that does not find correspondence in reality.

In both design and construction, in this and many other areas they proceed for experience, for information transmitted orally, habit and heard. The cases in which companies possess and use the Rules which concern their products are in reality a minority and concern the companies of excellence.

This fact is that the majority of the products CE marked and with “regular”declaration of conformity are in accordance with the requirements of the rules, but this is not verified by whoever agrees to the declarations.

What are the risks that customers run? In reality very few compared to those potential, because the manufacturers are not imbeciles or unable, but certainly superficial in signing documents that have nothing to comply, if not the form on which they are written.

In addition there is to say that many associations of category, not all, use to provide modules and fax similar of declarations, but they do not explain the importance of the CE marking on the level of security. Indeed they want to postpone the more possible the dates of entry into force of the directives and rules rather than help their members to put themselves in order. Has all this meaning?

Sometimes it is ridiculous that some associations say that the CE mark is not important, implying that they do not need the marking in the general sense, while they well know that if it is not always needed the mark, thedeclaration of conformity always serves, and so the difference between the mark and the declaration of conformity is only in the presence of the label.

The Members believe or pretend to believe to associations and they place on the market products which do not have the CE mark for which there has not been anyprocedure for security, in accordance with their associations. We ask then:-Qui prodet?-. Certainly not to the customers, who paradoxically may be the same in the various associations.

    How do I get a Cert. of conformity on a document tha was notarized out of State? Landlord is in Las Vegas. Document notarized in LV for an eviction of a tenant in New York City. The Court requires a Certif of Conf. on out of State notarized signatures. Where and how can I get it?

  9. Hy, it is not certification but CE mark , yes the softwares don’t need CE mark usually, but in particulary cases, for exaple in medical appareil

  11. Dear Roland,
    we do not know your Country’s law about importation, but we can think with logic. Companies outside Europe cannot be responsible of their product, because authorities have no “authority” outside Europe. So, the subject who become responsible is the importer or the representative (inside the community) of the foreign Company (Europan Directives).
    Directives allow importation but not the sale if the importer does not fulfill the CE mark task first. So it is up to you to proceed with the CE task and it is up to you to let a Notified Body test the products, if necessary (with the release of the CE certificate). Only when the task is done and the CE mark applied on the product (this means that you have checked its safety and that you have collected all the documents needed for the Technical File that you must keep for ten years after the ceased importation), you can sell the items.
    In Italy, however, we find some Customs Officers too “diligent”, and they stop the products without the right.

    I need a few Declarations of Conformity certificates/documents for all the products available from a Europen based company- GC Corporation Europe. My direct request to the company for these documents have been futile. Is there any other way of obtaining these certificates or documents such as from an online register that is held by the EU Authority resposible for the issuing of the CE Mark and these certificates.
    I need these certificates so that I can get permission from the government agency in my country to be able to import medical devices.

    We do not know where your medical devices come from. If they come from a Company outside the european community, it is you who become responsible of the products. It is up to you to redact and provide for the realization of the Technical File and the eventual tests to be done by a Notified Body.
    Companies outside Europe are not obliged in fulfilling the CE mark path. But if you have a trouble with customs, well, this is another story.
    Please tell us some more detail. Anyway I hope I was helpful.

    forgive my ignorance, but if the LDV Van is the vehicle that I found in the web (Uk Factory), you need nothing, just because european standards are the same, unless you bought the Van outside Europe (for example from the USA). The most important thing is that you do not make mistakes while driving on the right side.

    Marry Christmas and Happy New Year. What do you think about idea to collect electronic copy of EC Declaration of Conformity for all equipments for European countries in one database? I’m from Croatia and soon, I hope, will be part of European Union and in this case it will be easiest way in customs procedure -or not ;) . My national regulation about import electronic devices are similar as in other EU Country’s. I need some EC Declaration for one model of RC helicopter (WLToys model v911) and I have problem to find it. In case of database it will be easiest way, because this model of helicopter was import in some EU Countries. Producer for now didn’t give me EC Declaration :( .

    Your idea isn’t bad, but……..
    Declaration of conformity isn’t a burocratic format and isn’t a simple module, so a datase of declaration isn’t usefull to do an well done work.
    It’s necessary to run the right way of certification before to do thi declaration, so what to have a model resolves? Right nothing.
    CE marking is a right work method, You need to learn it and than You can mark CE.
